President Trump appointed Matthew Whitaker as acting attorney general last week. Critics say that Whitaker cannot constitutionally hold the office because he has not undergone Senate advice and consent. What do you think?

There is a law that he has abided by. It may not be constitutionally legal, but the law he used is legal. The question is flawed.

Whittaker can hold office, because it's temporary, and that makes it constitutionally legal. Eventually, an AG will have to be voted in.

Constitutionally, per the Vacancies Act, he can temporarily hold the office for 218 days until an A.G. is confirmed by the Senate.

President Trump can legally appoint Whittaker as temporary acting Attorney General for 210 days under the Vacancy Reform Act.

Yes, Whittaker can hold the office because it is a temporary position and does not need Senate confirmation. The Democrats are trying to obstruct, but they have no legal basis to stop this temporary appointment. Their argument that Whittaker cannot hold this position because he had some political OPINIONS about the Mueller invitation is ABSURD. That means anyone who simply voiced an opinion in the past that is contrary to what the Democrats want could be prevented from holding office. It’s complete nonsense and this Democrat tactic will not work.
